By accessing and using Aiartools ("Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Aiartools is an AI-powered image transformation service that allows users to:

  • Upload images for AI-powered editing and transformation
  • Apply various styles, filters, and modifications using text prompts
  • Download processed images in high resolution
  • Access advanced features through paid subscriptions

3. User Accounts

3.1 Account Creation

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must be at least 13 years old to create an account
  • One person or legal entity may maintain no more than one account

3.2 Account Responsibility

  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account
  • We reserve the right to suspend or terminate accounts that violate these terms

4. Acceptable Use

4.1 Permitted Uses

  • Personal and commercial image editing and transformation
  • Creating content for marketing, social media, and creative projects
  • Educational and research purposes

4.2 Prohibited Uses

You may NOT use our service to:

  • Upload or process images containing illegal, harmful, or offensive content
  • Create deepfakes or misleading content without proper disclosure
  • Process images of people without their consent
  • Generate content that violates intellectual property rights
  • Create content for harassment, discrimination, or hate speech
  • Attempt to reverse engineer or copy our AI models
  • Use automated tools to abuse our service or exceed rate limits

5. Subscription Plans and Payments

5.1 Free Plan

  • Limited to 5 image generations per month
  • Basic features and keywords only
  • Watermarked exports
  • Standard processing priority

5.2 Paid Plans

  • Subscriptions are billed monthly or annually
  • Payments are processed securely through third-party providers (Stripe)
  • Subscriptions are managed through your account dashboard

5.3 Cancellation and Refunds

  • You may cancel your subscription at any time through your account dashboard
  • Cancellation takes effect at the end of the current billing period
  • 7-day refund policy applies for unused credits (see our Refund Policy for details)

6. Intellectual Property

6.1 Your Content

  • You retain ownership of images you upload to our service
  • You grant us a limited license to process your images for service provision
  • You own the rights to images generated using our service
  • You are responsible for ensuring you have rights to upload and process images

6.2 Our Service

  • We own all rights to our AI models, algorithms, and service technology
  • Our service is protected by copyright, trademark, and other intellectual property laws
  • You may not copy, modify, or reverse engineer our service

7. Service Availability and Limitations

  • We strive for 99.9% uptime but do not guarantee uninterrupted service
  • We may temporarily suspend service for maintenance or updates
  • Processing times may vary based on server load and image complexity
  • We reserve the right to implement usage limits to ensure fair access
  • Some features may be in beta and subject to changes or removal

8. Privacy and Data Protection

Your privacy is important to us. Our data handling practices are detailed in our Privacy Policy, which forms part of these terms. Key points include:

  • Images are automatically deleted within 24 hours of processing
  • We do not share your images with third parties
  • Personal information is protected according to applicable privacy laws
  • You can request deletion of your data at any time

9. Disclaimers and Limitation of Liability

IMPORTANT LEGAL NOTICE:

  • Our service is provided "as is" without warranties of any kind
  • We do not guarantee the accuracy, quality, or suitability of generated images
  • We are not liable for any damages arising from use of our service
  • Our total liability is limited to the amount you paid for the service
  • You use our service at your own risk

10. Termination

We may terminate or suspend your account and access to the service at our sole discretion, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason.

Upon termination, your right to use the service will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive termination.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through our service. Continued use of the service after changes constitutes acceptance of the new terms.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these terms or use of our service shall first be resolved through good faith negotiation. If unresolved within 30 days, disputes may be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), or through the courts of Delaware, United States.
